This policy does not apply to subscribers of our services or suppliers (please refer to the data protection provisions in our terms and conditions with you) or employees. This Privacy Policy, together with our Terms of Service (and any other documents referred to in it) (this Policy) sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. Retaining your personal information. This information is kept for no more than twelve (12) months and will then be deleted automatically. However:

  • if we are required by law to retain it for longer, we will retain it for the required period; and/or
  • where the information is being used in connection with legal proceedings (including prospective legal proceedings) it will be retained for the duration of those legal (and any enforcement) proceedings.

Transferring your personal information outside the EEA. Cloud Officer’s office of operations is based in the United Kingdom. We do not have a permanent office presence outside of the EEA. However, some of the third parties we use to improve your experience of the Website are based outside the EEA, specifically in the United States of America. In respect of these third parties, we may transfer your personal information outside the EEA but this will be on the basis of the EU-US Privacy Shield, the standard EU Model Clauses or a finding of adequacy (as applicable).

2. Prospective clients and suppliers

Personal information we collect. If you contact us or we contact you (by phone, email, completing a form on our Website or otherwise), we will hold the following personal information:

  • your name and contact details, and any other details you give us when you make an enquiry (such as the details you complete if you use a form on our Website to contact us or details that appear on your business card which you provide to us);
  • information and documentation that you give us about your business activities including communications with you and people within your business;
  • information and documentation that we obtain about you and your business from publicly available information (e.g. your website, social media and Companies House) when we carry out research (this is to ensure that we understand you and your business); and
  • information you give us when you attend any of our events and/or webinars, whether hosted by us or a third party (including when you register to provide feedback) (which may also include use of sensitive personal information, such as dietary requirements).

We may also collect information:

  • on whether you open and/or click on URLs in our newsletters (if you want to stop us doing this, click through the preference centre link in any newsletter and select the option Unsubscribe); and
  • about you from social media platforms including when you interact with us on those platforms or access our social media content (the information we may receive is governed by the privacy settings, policies, and/or procedures of the applicable social media platform, and we encourage you to review them).

  • with our telephony supplier (which would get to see phone numbers if we call you) and our broadband supplier (which could see email addresses, but not the content of what you send us, if you encrypt it).

Retaining your personal information. If we both decide:

  • to enter into a contract, this information will be kept for the duration of your relationship with us, then 7 years. Our contract with you will set out our views and practices regarding use of (as applicable) a client’s or supplier’s personal information, not this Policy; or
  • not to enter into a contract, this information will be kept for the duration of your enquiry and for up to twelve (12) months thereafter or, if we are required by law to retain for longer, we will retain it for the required period and/or where the information is being used in connection with legal proceedings (including prospective legal proceedings) it will be retained for the duration of those legal (and any enforcement) proceedings.

3. Job applicants

Personal information we collect. If you contact us or we contact you (by phone, email or otherwise), we will hold your name and contact details as well as details you provided during the application process (including any tests we ask you to complete, interviews you attend and pre-employment checks we are required by law to undertake). We may collect information about you from social media platforms including when you interact with us on those platforms or access our social media content. The information we may receive is governed by the privacy settings, policies, and/or procedures of the applicable social media platform, and we encourage you to review them. The information we ask you to provide during the application process is used to assess your suitability for employment. You don’t have to provide what we ask for, but it might affect your application if you don’t.

You will also be asked to provide equal opportunities information. This is not mandatory information – if you don’t provide it, it will not affect your application. This information will not be made available to any staff outside of our recruitment team, including hiring managers, in a way which can identify you. Any information you do provide, will be used only to produce and monitor equal opportunities statistics. We don’t record calls. If you visit our offices, personal information will be collected about you on CCTV cameras which operate on our premises. CCTV cameras are used for crime prevention and public safety.

Using your personal information. We will use this information:

  • to evaluate your job application (we will use this information where we are required by law to do so and in order to take steps prior to entering into an employment contract with you); and
  • to protect the rights, property, or safety of Cloud Officer, our clients, suppliers, contacts or others (we will use this information where we are required by law to do so and to pursue our, or a third party’s, legitimate interests).

Any equal opportunities information you provide will not be made available to any staff outside of our recruitment team, including hiring managers, in a way which can identify you. Any information you do provide, will be used only to produce and monitor equal opportunities statistics.

Sharing your personal information. We will only share personal information with third parties in the following instances:

  • our recruitment team (but their use shall be limited to the performance of their duties and in line with the reason for processing);
  • where we are working with a third-party recruitment provider to provide them with feedback on your job application;
  • with our third party talent management platform provider, where such use shall be restricted to the processing of applications and the internal tracking and assessment of candidates;
  • if we sell or buy any business or assets, in which case we may disclose your personal information to the prospective seller or buyer of such business or assets;
  • in connection with any legal proceedings (including prospective legal proceedings);
  • where we are required by law to do so; and/or

Retaining your personal information. If you are successful for the position you have applied for, details of our practices and procedures will be set out in your employment documentation. If you are unsuccessful for the position you have applied for, we may ask if you would like your details to be retained in our talent pool for up to twelve (12) months. Personal information we collect:. If you contact us or we contact you (by phone, email or otherwise) for any other reason (e.g. you are not a prospective client or supplier, or a job applicant), we will hold your name, contact details and any other details you give us (such as the details you complete if you use a form on our Website to contact us). We may also collect:

  • information and documentation that we obtain about you and your business from publicly available information (e.g. your website, social media and Companies House) when we carry out research (this is to ensure that we understand you and your business);
  • information you give us when you attend any of our events and/or webinars (including when you register to provide feedback) (which may also include sensitive personal information, such as your dietary requirements);
  • information about you from social media platforms including when you interact with us on those platforms or access our social media content (the information we may receive is governed by the privacy settings, policies, and/or procedures of the applicable social media platform, and we encourage you to review them); and

Your rights

In relation to personal information we hold about you, you have the right to:

  • get access to your personal information that we hold and receive information about our processing of it;
  • ask us to correct the record of your personal information maintained by us if it is inaccurate or to complete incomplete personal information;
  • ask us, in certain instances, to erase your personal information or cease processing;
  • object to us processing your personal information for direct marketing purposes;
  • challenge us processing your personal information which has been justified on the basis of our legitimate interests;
  • ask us, in certain instances, to restrict processing personal information to merely storing;
  • not to be subject to automated decision making (including profiling) in certain circumstances;
  • request a copy of an agreement under which your personal information is transferred outside of the EEA;

How we protect your personal information

To help protect the privacy of personal information you transmit, we maintain physical, technical and administrative safeguards and require the same of any third parties we share your personal information with. We update and test our security technology on an ongoing basis. In addition, we train our staff about the importance of confidentiality and maintaining the privacy and security of your personal information. However, as you will be aware, the transmission of information via the internet isn’t always secure. Although we will do our best to protect your personal information, we can’t guarantee the security of your personal information transmitted to our Website; any transmission is at your own risk.
